GENERAL TERMS AND CONDITIONS
Frauenau Glass Museum - State Museum of the History of Glass Culture (AGB)
1. validity
1.1 The following provisions apply to the purchase of all types of tickets, vouchers and participation in public guided tours at the Frauenau Glass Museum.
1.2 This includes the purchase of tickets a) at the ticket offices of the Glasmuseum Frauenau b) online.
1.3 These GTC apply in addition to the general provisions of the GMF, namely the house rules of the Frauenau Glass Museum, as well as the respective individual house rules and cloakroom regulations, which can be viewed on site in the museums or online via the www.glasmuseum-frauenau.de website. By purchasing tickets, the customer* recognises these general terms and conditions of the GMF as binding. Deviating terms and conditions of the customer shall not become part of the contract unless the GMF agrees to their validity in writing.
1.4 Tickets are only sold to end customers, otherwise there is no entitlement to the service provided by GMF on the ticket. The GMF is authorised to limit the number of tickets to be sold per customer in individual cases and in online sales.
1.5 The purchase of services in accordance with the following provisions creates a contractual relationship exclusively between the customer and GMF. Resale of the purchased tickets is not permitted.
2. types of tickets offered
2.1 The GMF is responsible for deciding which of the following ticket types will be offered for sale at the GMF.
2.2 Tickets for each individual museum Tickets for the museum only entitle the holder to visit the permanent collection and special exhibitions during the respective opening hours on the day of purchase, unless otherwise specified in the 2 type of ticket. Tickets for special exhibitions subject to a charge, which are not included in the visit to the permanent collection, only entitle the holder to visit the respective special exhibition, unless otherwise specified. After their first use for admission, tickets are no longer transferable.
2.3 Gift vouchers Gift vouchers can be purchased at the GMF ticket office and in the webshop.
2.4 Time slot tickets The GMF is entitled, at its discretion and according to objective standards, in particular for reasons of visitor safety or for conservational reasons, to make admission dependent on prior booking of an appointment and to issue tickets in accordance with Section 2.4.
2.2. with a fixed admission or validity period (time slot tickets). Time slot tickets only authorise admission during the admission time or period of validity printed on them. If the visitor capacity is exceeded due to the number of visitors despite time slot tickets, waiting times of up to 30 minutes must be accepted.
3. prices and payment
The admission prices and regulations on concessions and free admission are set out in the GMF's current admission price regulations, which can be viewed in each museum in the ticket office area and on the GMF website at www.glasmuseum-frauenau.de. The applicable currency is the euro. Admission prices are subject to change without notice. 3.1 Tickets, vouchers and public guided tours are exempt from VAT in accordance with § 4 No. 20 a UStG.
3.2 When claiming concessions or free admission, a corresponding valid confirmation and, if applicable, additional photo ID must be presented when purchasing at the GMF ticket offices and on the day of the visit when entering the exhibition rooms. Proof must also be shown on request at the entrance to the museum or exhibition. If proof cannot be provided, the difference to the full admission price must be paid in arrears.
3.3 Products purchased purely digitally (cf. sentence 1, section 3.4.2.2.) must be printed out by the customer before visiting the museum and/or presented in a digitally readable form (e.g. on the display of a smartphone) when visiting the museum. Admission will only be granted if the QR code is fully legible.
3.4 Payment
3.4.1 Payment at the cash desks
3.4.1.1 Payment is made at the GMF cash desk. Cash payment and payment by EC or credit card from most major providers (VISA, Master Card, American Express, etc.) are generally available as payment options.
3.4.1.2 When paying by EC card, the customer must ensure that the account is covered. Costs incurred due to chargebacks shall be borne by the customer as long as GMF is not responsible for the chargeback. In individual cases, GMF is authorised to accept only certain payment methods depending on the respective customer.
3.4.2 Payment and dispatch in the online shop
3.4.2.1 In the case of online sales, payment is made in advance by the customer using one of the payment methods offered. Purchase on account is not possible.
3.4.2.2 The dispatch of the products referred to in Section 2 shall be made digitally by e-mail to the e-mail address provided by the customer.
4. revocation/cancellation
A return or cancellation of products purchased at the cash registers and in the webshop is generally excluded. A statutory 14-day right of cancellation applies to products purchased online under section 2.3, provided that no (partial) services have yet been used. Details on cancellation can be found in GMF's cancellation policy at www.glasmuseum-frauenau.de.
5. admission and domiciliary rights
5.1 The customer must present the ticket purchased at the cash desk or in the online shop (see 3.3.) in printed or digital form when entering the exhibition rooms. The ticket will be scanned at the entrance. During the visit to the exhibition rooms, the customer must carry it with them and show it to the supervisory staff on request.
5.2 GMF staff are authorised at any time to issue instructions deviating from these GTC at their own discretion on the basis of their domiciliary rights.
5.3 In the event of violation of these GTC, the house rules, the instructions of the GMF staff and the GMF cloakroom regulations, the GMF or its authorised representatives reserve the right to expel the customer from the GMF or to issue a general ban from the premises. This also applies if the ticket holder causes a nuisance to other visitors and/or disrupts museum operations or poses a risk of disruption.
6. limitation period
The statutory limitation period for vouchers is three years from the end of the year in which the ticket was purchased.
7. loss/damage and exchange
The GMF is not liable for the loss, expiry or damage of tickets or vouchers. There will be no replacement or refund in the event of loss or damage.
8 Public guided tours
8.1 The GMF offers both paid and free public guided tours with a limited number of participants.
8.2 For participation in public guided tours of the GMF with limited attendance, the customer must purchase a separate guided tour ticket on the same day in advance of the tour at the museum ticket office or online. This is a prerequisite for participation in the tour. The purchase of a general admission ticket for the museum does not entitle the customer to a place on a guided tour. Proof of entitlement to participate in the guided tour does not replace the purchase of a ticket mentioned under point 2.
8.3 A postponement of the dates by up to 30 minutes compared to the specified time does not entitle to a reduction of the fee for the guided tour. The time will be made up by the museum guide accordingly. In the event of delays beyond this, the guided tour will be cancelled. In this case, the regulation mentioned under point 8.4. applies.
8.4 The GMF is entitled to cancel the public tour if there is an important reason (e.g. cancellation of the speaker, exceeding the visitor capacity, force majeure according to section 9.2). In this case, the participation fees already paid will be refunded for tours for which payment is due. Participants are not entitled to any further claims for damages. Tickets already purchased for access to the exhibition rooms cannot be returned (see section 4), unless there is also a reason as per section 9.2. 5
9 Liability of the GMF
9.1 GMF shall only be liable for damages caused by intent or gross negligence on the part of GMF, its employees or its vicarious agents. Any further liability, insofar as it is not provided for by mandatory statutory provisions, is expressly excluded. The limitation of liability does not apply in particular to damages resulting from injury to life, limb or health or the breach of material contractual obligations.
9.2 If a visit to a museum or an exhibition and thus the use of tickets is not possible due to compelling reasons within the sphere of the GMF (conservational, organisational or technical reasons) or due to force majeure (e.g. closure orders by security authorities or authorities superior to the GMF, natural disasters, pandemics, war, etc.), the GMF is entitled to withdraw from the contract. In this case, the ticket price will be refunded. The GMF accepts no further liability.
9.3 As far as possible, closures will be announced in good time in advance on the GMF website.
9.4 For structural or organisational reasons, individual parts of the exhibition may be closed or certain exhibits may be inaccessible. This does not entitle to a reduction of the fee or to claims for damages.
10. final provisions
10.1 The law of the Federal Republic of Germany shall apply exclusively, without reference to international private law. The sole place of fulfilment for performance and payment is Munich. The place of jurisdiction for disputes with merchants, legal entities under public law and special funds under public law as well as persons who have their domicile or usual place of residence abroad is Munich.
10.2 Deviations from or additions to these provisions must be made in writing. This also applies to the written form requirement itself.
10.3 GMF reserves the right to amend these GTC at any time without giving reasons. These changes shall not apply to orders already placed or existing purchase contracts.
10.4 Should individual provisions of these GTC be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions. The ineffective provisions shall be replaced by the statutory provisions, if any.
